Habeas Corpus (Advanced)

Location: Nautilus 4
Date: Sat, March 25
Time: 3:15 PM - 4:30 PM

This will be an interactive, conversational session, designed for those lawyers and investigators who have some experience preparing and litigating habeas corpus petitions. The specific topics to be addressed will depend on the needs and interests of the attendees, but will likely include matters such as the requirements of habeas petitions under 28 U.S.C. § 2244 (such as the statute of limitations), the requirements of § 2254(d) for adjudications on the merits in state court and the standards for granting relief ("contrary to, or involved an unreasonable application of, clearly established Federal law, as determined by the Supreme Court of the United States" or "based on an unreasonable determination of the facts"), the showings required to get a hearing in federal court, and ways to get around procedural default.
